In this paper, we try to expose the fundamental ideas at the basis of Jorge Millas’ axiology. First, we will expose synoptically the core of the legal philosophy that the Chilean thinker develops on his works on the subject, including his conception about philosophy in general , and about legal science in particular . Secondly, we will expose the epistemological suppositions of his legal philosophy , and his consequent conception of law’s essence , the legal rule and its foundation, and (...) the axiological theory that Millas develops on the basis of the distinction and relationship between “is” and “ought” . We conclude with a critical analysis that pretends to expose the strengths and weaknesses of the legal theory of this Chilean author. (shrink)

The emergent Coronavirus Disease 2019 caused by the Severe Acute Respiratory Syndrome Coronavirus 2 could produce a maternal immune activation via the inflammatory response during gestation that may impair fetal neurodevelopment and lead to postnatal and adulthood mental illness and behavioral dysfunctions. However, so far, limited evidence exists regarding long-term physiological, immunological, and neurodevelopmental modifications produced by the SARS-CoV-2 in the human maternal-fetal binomial and, particularly, in the offspring. Relevant findings derived from epidemiological and preclinical models show that a MIA (...) is indeed linked to an increased risk of neurodevelopmental disorders in the offspring. We hypothesize that a gestational infection triggered by SARS-CoV-2 increases the risks leading to neurodevelopmental disorders of the newborn, which can affect childhood and the long-term quality of life. In particular, disruption of either the maternal or the fetal cholinergic anti-inflammatory pathway could cause or exacerbate the severity of COVID-19 in the maternal-fetal binomial. From a translational perspective, in this paper, we discuss the possible manifestation of a MIA by SARS-CoV-2 and the subsequent neurodevelopmental disorders considering the role of the fetal-maternal cytokine cross-talk and the CAP. Specifically, we highlight the urgent need of preclinical studies as well as multicenter and international databanks of maternal-fetal psychophysiological data obtained pre-, during, and post-infection by SARS-CoV-2 from pregnant women and their offspring. Ao descrever como Xiang’er, uma mulher rural, torna-se lésbica nas aldeias, pode-se ver a “riqueza” e o “significado metafórico” do símbolo lésbico. No que diz respeito ao Lago Gato Selvagem, é mais interessante tratar como Xiang’er se torna lésbica, que não se refere apenas sobre sexo ou gênero, mas também sobre opressão política e econômica; assim, o chamado gênero, entendido utopicamente, poderá ser identificado. Além disso, (...) a perda da subjetividade rural durante a ampliação e a transformação posterior, a nova opressão e a exploração resultantes são as razões fundamentais para Xiang’er se tornar lésbica e eventualmente “matar seu marido”. La reflexión antigua y fundamental acerca del nombre involucra el doble compromiso de abordar el mythos y el logos. Entre Heráclito y Platón, los presupuestos filosóficos sobre el nombre confrontarán la búsqueda de una transparencia y una convencionalidad entre los nombres y las cosas. Primero, la oscuridad atribuida a Heráclito no margina el tratamiento del nombre como oráculo que revela y oculta al mismo tiempo. Y segundo, la dialéctica socrática por su parte, niega, pero también concede la naturalidad y arbitrariedad (...) del nombre, el único instrumento real para designar y distinguir. Desde múltiples perspectivas el presente artículo examina estas propuestas y da razones para incluir propiedades de los nombres distintas a sus referentes; razones que toda teoría genuinamente semántica debe incorporar. Resumen: El presente trabajo investiga la forma en que las ciencias sociales, principalmente chilenas, están respondiendo a las dispares demandas que reciben actualmente y que consisten en aportar a la comprensión crítica de fenómenos relevantes para la sociedad y adecuarse a las recientes transformaciones en la forma de producir y comunicar conocimiento científico incorporando mayores niveles de internacionalización, globalización, especialización y complejización. Para ello se realiza una revisión sistemática de la producción científica publicada sobre el movimiento estudiantil chileno, que constituye (...) uno de los movimientos sociales más relevantes de la historia reciente de Chile. Se sistematizaron 149 publicaciones editadas entre el año 2000 y el 2016. Los resultados muestran que la capacidad de las ciencias sociales chilenas para abordar estas demandas contradictorias es parcial, pues sus análisis críticos tienden a ser uniformes y de alcance temporal limitado, mientras que sus estudios empíricos no siempre poseen los niveles de internacionalización y complejidad demandados actualmente para participar en los circuitos internacionales de publicación.: The present work investigates the way in which social sciences, mainly Chilean, are responding to different demands that they are currently receiving and that consist of contribute to the critical understanding of phenomena relevant to society and adapt to recent transformations in the way of producing and communicating scientific knowledge, incorporating higher levels of internationalization, globalization, specialization and complexity. To this end, a systematic review of the scientific production published on the Chilean student movement is made. This movement is one of the most relevant in Chile's recent history. 149 publications were systematized, published between 2000 and 2016. The results show that the capacity of the Chilean social sciences to deal with these contradictory demands is partial, since their critical analyzes tend to be uniforms and limited in time, while their empirical studies do not always have the levels of internationalization and complexity currently demanded in international publishing circuits. In the remainder of this article, we will disarm an important motivation for epistemic contextualism and interest-relative invariantism. We will accomplish this by presenting a stringent test of whether there is a stakes effect on ordinary knowledge ascription. Having shown that, even on a stringent way of testing, stakes fail to impact ordinary knowledge ascription, we will conclude that we should take another look at classical invariantism. Here is how we will proceed. Section 1 lays out some limitations of previous (...) research on stakes. Section 2 presents our study and concludes that there is little evidence for a substantial stakes effect. Section 3 responds to objections. The conclusion clears the way for classical invariantism. This article examines whether people share the Gettier intuition (viz. that someone who has a true justified belief that p may nonetheless fail to know that p) in 24 sites, located in 23 countries (counting Hong Kong as a distinct country) and across 17 languages. We also consider the possible influence of gender and personality on this intuition with a very large sample size. Finally, we examine whether the Gettier intuition varies across people as a function of their disposition to (...) engage in “reflective” thinking. (shrink)

Many philosophers hold that if an agent acts intentionally, she must know what she is doing. Although the scholarly consensus for many years was to reject the thesis in light of presumed counterexamples by Donald Davidson, several scholars have recently argued that attention to aspectual distinctions and the practical nature of this knowledge shows that these counterexamples fail. In this paper I defend a new objection against the thesis, one modelled after Timothy Williamson’s anti-luminosity argument. Since this argument relies on (...) general principles about the nature of knowledge rather than on intuitions about fringe cases, the recent responses that have been given to defuse the force of Davidson’s objection are silent against it. Moreover, the argument suggests that even weaker theses connecting practical entities with knowledge are also false. Recent defenders of the thesis that there is a necessary connection between knowledge and intentional action are motivated by the insight that this connection is non-accidental. I close with a positive proposal to account for the non-accidentality of this link without appeal to necessary connections by drawing an extended analogy between practical and perceptual knowledge. Since at least Hume and Kant, philosophers working on the nature of aesthetic judgment have generally agreed that common sense does not treat aesthetic judgments in the same way as typical expressions of subjective preferences—rather, it endows them with intersubjective validity, the property of being right or wrong regardless of disagreement. Moreover, this apparent intersubjective validity has been taken to constitute one of the main explananda for philosophical accounts of aesthetic judgment. But is it really the case that most people (...) spontaneously treat aesthetic judgments as having intersubjective validity? In this paper, we report the results of a cross‐cultural study with over 2,000 respondents spanning 19 countries. Despite significant geographical variations, these results suggest that most people do not treat their own aesthetic judgments as having intersubjective validity. We conclude by discussing the implications of our findings for theories of aesthetic judgment and the purpose of aesthetics in general. (shrink)

In fact, he might be considered the father of the von Neumann architecture computer and the pioneer of Artificial Intelligence. And all thanks to his machines; both those that Church called “Turing machines” and the a-, c-, o-, unorganized- and p-machines, which gave rise to evolutionary computations and genetic programming as well as connectionism and learning. Recent analytic-philosophical works in the field of situated cognition have proposed to conceptualize the self as deeply entwined with the environment, and even as constituted by it. A common move has been to characterize the self in narrative terms, and then to argue that the narrative self is partly constituted by narratives about the past that are scaffolded (shaped and maintained) by, or distributed over, a variety of objects that can rekindle episodic memories. While we are sympathetic to these approaches, (...) here we propose a different strategy to situate the self—one which can be seen as complementing the narrative one, and which draws from concepts and ideas central to the phenomenological-existentialist tradition. We suggest, first, that the self has a sense of its past not just via narratives and episodic memories, but in virtue of being embodied and thus, importantly, sedimented (in other words, it has, or rather is, a body memory). Embodiment and sedimentation, in turn, always necessarily imply an environment or a situation, entailing that the self is also inherently situated. Second, we discuss the future-oriented dimension of selfhood, and argue that we understand ourselves as projected into the future, again not necessarily only narratively and reflectively, but also tacitly, in a bodily and inherently situated way. El trabajo tiene como hilo conductor la diferenciación efectuada por P. Ricoeur respecto del lenguaje entre la lengua, el discurso oral, la escritura y la lectura. Cada uno de estos modos de lenguaje puede ser examinado según los fenómenos de la temporalidad, la subjetividad, el mundo y la intersubjetividad. Siguiendo a M. Presas, este esquema se aplica al arte y a su función de dejar que las cosas se manifiesten en su plena presencia. Se destaca su énfasis en la liberación (...) efectuada por el arte respecto de la limitación fáctica de nuestra situación finita. Esto se logra mediante la apertura a la verdad de una existencia posible que no se identifica con una evasión de la realidad. Los análisis de Presas se centran en P. Klee y F. Marc, y destacan los rasgos distintivos relacionados con los mencionados fenómenos. En el intento de ofrecer un complemento a este examen, se mencionan las interpretaciones de Merleau-Ponty sobre P. Cézanne, de M. Henry sobre V. Kandinsky y de J.-C. Marion sobre G. Courbet. Se muestra que en ellas también se encuentran explicitaciones de lo que Presas ha afirmado sobre la discordia, el ser insular y la ausencia de apremio. (shrink)

In pediatric emergency rooms (ERs), social workers must navigate diverse responsibilities including acting as advocates and liaisons between families and multidisciplinary treatment teams, providing compassionate support to families in crisis, and assessing for and reporting any suspicions of child abuse or neglect. These potentially contrasting roles can place social workers at the center of dealing with ethical dilemmas and advocating against ethical violations, such as bias and discrimination toward families. This qualitative study seeks to gain insight into ethical issues commonly (...) encountered in pediatric ERs by exploring the perspectives of 23 social workers at Level 1 trauma centers in the United States. Thematic analysis was used to develop major themes and subthemes related to ethical violations, dilemmas, and best practices in pediatric ERs. Major themes emerged related to unfair treatment of families (with subthemes of bias, discrimination, and compassion fatigue), ethical dilemmas (with subthemes of cultural issues, safety and system issues), and promoting ethical practices (with subthemes of self-awareness, advocacy, and efforts to change the system). This study provides important insights into ethical issues in pediatric ERs as experienced by social workers and can inform efforts to improve the quality and equity of care for all families in pediatric ERs. Sin embargo, ello es inadecuado para analizar la vida social. Una de las características básicas de la acción es que ella no es clara, sino que opera en un mundo que es confuso. La exigencia entonces ha de transformarse de forma tal que la exigencia metodológica no se traduzca en (...) una exigencia sobre la realidad. Does the Ship of Theseus present a genuine puzzle about persistence due to conflicting intuitions based on “continuity of form” and “continuity of matter” pulling in opposite directions? Philosophers are divided. Some claim that it presents a genuine puzzle but disagree over whether there is a solution. Others claim that there is no puzzle at all since the case has an obvious solution. To assess these proposals, we conducted a cross-cultural study involving nearly 3,000 people across twenty-two countries, speaking eighteen (...) different languages. Our results speak against the proposal that there is no puzzle at all and against the proposal that there is a puzzle but one that has no solution. Our results suggest that there are two criteria—“continuity of form” and “continuity of matter”— that constitute our concept of persistence and these two criteria receive different weightings in settling matters concerning persistence. Este artículo plantea, expone y confronta la dualidad poliana entre dos estatutos del lenguaje como hábito intelectual y como hábito de la razón práctica. Para hacerlo parte de la confrontación entre la filosofía sobre el lenguaje que elabora Polo y la filosofía desde el lenguaje propia de la tradición analítica. Sólo así cabe dar razón de la originalidad de la concepción poliana acerca del lenguaje.

The aim of our experiment was to analyse the effect of the emotional valence (positive, negative, or neutral) on true and false recognition, matching the arousal, frequency, concreteness, and associative strength of the study and recognition words. Fifty younger adults and 46 healthy older adults performed three study tasks (with words of different valence: positive, negative, neutral) and their corresponding recognition tests. Two weeks later, they performed the three recognition tests again. The results show that words with a negative valence (...) produced less true recognition and less false recognition than words with a positive or neutral valence, in both younger and older adults, on the immediate recognition test. This pattern of results was also found in the younger adults on the delayed recognition test, whereas in the older participants, these differences disappeared. Thus, when arousal is controlled, both younger and older adults tend to recognise negative information worse than positive or neutral information, but they also commit fewer errors. Results would suggest that the greater arousal commonly associated with negative stimuli, rather than their own valence, could explain some of the contradictory results found in the literature.
